Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed through the online shop at www.ear-shield.com.

The online shop is intended for consumers.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

You can place products in the cart and review or change your entries at any time before submitting the order. By clicking the final order button, you submit a binding offer to purchase the goods contained in the cart.

After receiving your order, we will send you an automatic confirmation by email. Your offer is accepted either by express acceptance by email or by dispatch of the goods.

3. Prices and Small Business VAT Status

All prices are final prices in euros. In accordance with Section 19 of the German VAT Act, VAT is not shown separately.

Shipping costs may be added to the stated product prices. The shipping costs are shown in checkout before you complete your order.

4. Payment Methods

The payment methods available in the shop are shown in checkout.

The shop offers Shopify Payments, for example credit card or supported wallets, as well as PayPal.

Payment processing is handled by the payment service provider selected during checkout. Further information is shown in checkout.

5. Delivery

We deliver to Germany, countries of the European Union and Switzerland.

Delivery is made as a letter shipment to the delivery address provided by you.

The expected delivery times and shipping costs are stated in our Shipping Policy. The shipping costs shown in checkout are decisive.

For deliveries to Switzerland, additional import duties, taxes, customs duties or handling fees may arise. These costs are not charged by us and may have to be borne by the recipient.

6. Retention of Title

The goods remain our property until full payment has been received.

7. Right of Withdrawal

Consumers have the statutory right of withdrawal. Details are set out in our Withdrawal Policy.

From 19 June 2026, we also provide an electronic withdrawal function. It is available at https://www.ear-shield.com/pages/widerruf and via the corresponding link or button in the shop.

8. Statutory Warranty Rights

The statutory warranty rights apply.

An additional voluntary guarantee exists only if it is expressly stated for the respective product.

9. Liability

We are liable without limitation for damages arising from injury to life, body or health, in cases of intent and gross negligence, under the German Product Liability Act and in all other legally mandatory cases.

In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damage typical for this type of contract. Essential contractual obligations are obligations whose fulfilment enables the proper performance of the contract in the first place and on whose compliance you may regularly rely.

In all other respects, liability is excluded.

10. Contract Language and Storage of Contract Text

The contractual language is German. English content is provided to make the shop easier to understand internationally.

We do not store the contract text in a way that remains permanently accessible to you. You will receive the order data and these Terms and Conditions as part of the order confirmation by email, or you can access the current version on our website.
